These Terms of Service govern your use of InstaAgent, a product of Workstream AI, LLC ("Workstream AI", "we", "us", or "our"), accessible at insta-agent.ai and its subdomains. By accessing or using InstaAgent, you agree to be bound by these Terms.

1. Use of Service

InstaAgent provides AI-powered voice agent and CRM automation services. You agree to use the service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring your use of InstaAgent complies with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and any applicable state telemarketing laws.

2. Demo Request Calls — Automated Calling Consent

InstaAgent's website offers a live product demonstration delivered via an automated outbound telephone call. By submitting the demo request form, you:

• Expressly consent to receive a single automated telephone call from Workstream AI, LLC at the phone number you provide.
• Acknowledge that the call may use automated dialing technology and an AI-generated voice.
• Confirm that this consent is not a condition of purchase. You are not required to submit a demo request or consent to a call in order to purchase or use InstaAgent.
• Agree that Workstream AI, LLC may log your consent record, including timestamp, IP address, and the consent language presented, for TCPA compliance purposes.

3. Customer Responsibilities for Outbound Calling

If you use InstaAgent to make outbound calls to your own contacts or customers, you are solely responsible for:

• Obtaining all required consents before initiating calls to any individual.
• Maintaining Do-Not-Call lists and honoring opt-out requests.
• Complying with TCPA, TSR, and all other applicable federal and state laws.
• Ensuring calls are made only during permissible hours.

Workstream AI, LLC is not liable for any violations of telecommunications law arising from your use of InstaAgent to contact your own customers or leads.

4. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@insta-agent.net if you suspect unauthorized access.

5. Intellectual Property

InstaAgent and all related technology, content, and materials are the property of Workstream AI, LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the service without our express written consent.

6. Disclaimer of Warranties

InstaAgent is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by law, Workstream AI, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of InstaAgent.

8. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of InstaAgent after changes take effect constitutes your acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions.
